I'm pretty sure you're correct in what you say. Any method of separating bands judged to be pretty much equally good is going to be somewhat arbitrary, though. Perhaps a better method would be to award the higher place to the band with the highest median place (i.e., highest middle score). This would remove the effect of an anomalously high or low placing from one judge. Obviously this could still leave the bands even, but bands which are even after this really are too close to call and (barring having more judges to get some kind of significant set of statistics) something more or less random is required.
