West Side Story was copyrighted back in the 50s when Bernstein wrote it. That copyright never changes. If a new arrangement is published it must be licensed by the original copyright holder. In the case of Bernstein's music, his estate keeps a firm grip on who is able to license the use of it. It's practically impossible. This is why arrangements of his music are found in manuscript and not published. Printed music is different then recorded music. Once a "new" piece of music has been recorded, anyone can record it without permission. Of course, you must pay the publisher's fees. Copyright laws differ slightly from country to country.
