I'm no lawyer, but:

As I understand it, if that statement be proved to be the case, then the
neighbour may not have any grounds for complaint. I'm sure I heard on
the radio that there are plenty of precedents covering "incomers" complaining
about the existing environment such as cricket matches and pongy farmers, in each of
these cases the protester lost because it was in place before they
came into the area.
